New garden terrace competition

The Game and its promotion are not managed or sponsored by Instagram. In this context, the Organizing Body discharges Instagram of any responsibility concerning all elements related to the Game, its organization and promotion.

Article 2 – DATE OF OPERATION

The competition runs from Saturday, May 3 at 12 noon to Monday, May 12, 2025 at noon (Paris date and time).

Article 3 – CONDITIONS OF PARTICIPATION

3.1. Participation in the Game implies unreserved acceptance of the present Rules in their entirety, of the rules of deontology in force on the Internet, and of the laws, regulations and other texts in force in France. Failure to comply with the conditions of participation set out in the Rules will render the participation in question null and void.

3.2. Participation in the Game is reserved for any natural person meeting the following cumulative conditions at the start of the Game (hereinafter the “Participant”):

– Be of legal age ;

– Have an Internet connection and a personal account on the Instagram community site (“Instagram Account”)

– Reside in mainland France ;

– Have a personal electronic address (email) to which they can, if necessary, be contacted for the purposes of managing the game;

– Official identification;

– Be able to go to Les Deux Magots (by their own means) to receive the prize if they win the Game.

3.3. Minors, members of the staff of the organizing company (SAS LES DEUX MAGOTS) and members of their immediate families (parents, brothers and sisters or any other person residing in the same household) are excluded from participation in the Game.

3.4. Only entries that comply with all the provisions of the Rules will be accepted. Consequently, the Organizing Body reserves the right to make all necessary verifications concerning the identity, age and contact details of each Participant.

Article 4 – CONDITIONS OF PARTICIPATION

Participation in the Game-Contest implies express and unreserved acceptance of the present Rules, in their entirety, and of the legislation in force on French territory (in particular, the laws relating to Information Technology, Civil Liberties, public decency and literary and artistic property).

Participation in the Contest is free and no purchase is necessary for the duration of the Contest.

4.1. The Game will be accessible exclusively from the Deux Magots Instagram account (https://www.instagram.com/lesdeuxmagots/). Participation in the Game on plain paper or in any other form is excluded.

The Participant can access the game after logging on to Instagram and visiting the aforementioned page. By participating, the Participant acknowledges that he/she has read these rules and accepts them unreservedly.

The publication dedicated to the competition will be posted and pinned on the Les Deux Magots Instagram page for the duration of the competition.

To participate in the game, you must :

– comment on the question asked in the publication

– follow the Deux Magots account

Only Participants meeting these criteria will be accepted by the Organizing Body and will be able to take part. Any entry to the Contest that is incomplete, does not comply with the conditions set out in these Rules, is falsified, is validated after the entry deadline or contains false information will be considered null and void.

4.2. In particular, but without this list being limitative, any comment will be automatically refused:

– vulgar, pornographic, racist, paedophilic or harmful to minors; – defamatory, insulting or slanderous towards third parties, natural or legal persons;

– of a political nature and/or deemed sensitive by the Organizing Body;

– infringe the privacy or image rights of third parties and/or contravene applicable laws;

– contrary to morality and/or public order;

– reproducing an item subject to intellectual or industrial property rights, such as, but not limited to, an original work, a trademark, a registered design, a patent, etc.

Similarly, the Participant undertakes to comply with the rules in force concerning intellectual property, and thus not to reproduce, represent, distribute or modify in any way whatsoever any content (signs, writings, images or messages of any kind) for which he/she has not obtained the express authorization of the rights holders at the time of his/her participation.

Each Participant may participate only once during the entire duration of the Contest and may participate only on his or her own behalf.

Article 5 – AWARDS

The organizing company is offering one (1) prize for the Winner and the person of his/her choice, which will be awarded to the participant selected at random:

• 2 afternoon snacks on the garden terrace (1 pastry from our selection of “pastries of the day” + 1 drink from our selection of soft drinks and hot non-alcoholic beverages).

It is specified that the lot offered includes only what is indicated above with the exception of anything else. Any additional costs (transport, additional drinks….) will be borne by the Winner.

Article 6 – DESIGNATION OF THE WINNER – RANDOM DRAWING

The Winner will be chosen from among all the participants in a draw to be held on Monday, May 12, 2025 at noon at the organizing establishment.

The Organizing Body will contact the Winner no later than 5:00 p.m. on May 12, 2025, in accordance with the terms and conditions specified in the following article.

Article 7 – ALLOCATION OF LOTS

The Organizing Body will contact the winner no later than May 12, 2025 by private message on Instagram. They will then be asked to provide the following information to verify their identity (surname, first name, address, town, zip code, telephone number, e-mail address) and a date to visit Les Deux Magots to reserve a table for two.

The Winner must indicate his/her wish to receive the prize by return message no later than May 15, 2025 at 11:59 pm. Failure to reply within the time limit will constitute forfeiture of the prize by the Winner, who will then be replaced by the substitute Winner. If the prize is relinquished again, it will become the property of the Organizing Body.

No notification will be sent to Participants who have not won.

The prize awarded may not be contested in any way whatsoever by the Winner. The prize is strictly personal, and may not be transferred or sold to any third party whatsoever; it may not be the subject, on the part of the Organizing Body, of any reimbursement in cash or any exchange or remittance of its total or partial counter-value, in kind or in cash.

The Prize will benefit the Winner selected at random and the person of his/her choice only. It is not possible for the Winner to designate a third party to replace him/her and benefit from the prize won by drawing lots.

ARTICLE 8 – FORCE MAJEURE

The Organizing Body may not be held liable if, for a reason beyond its control and/or in the event of force majeure, the Contest should be shortened, modified, postponed or cancelled; and this without any compensation being due to participants.

ARTICLE 9 – LIMITATION OF LIABILITY

The Organizer may not under any circumstances be held responsible for, without this list being limitative:

– the loss of any data;

– preventing or limiting the possibility of participating in the Game;

More generally, the Organizer declines all responsibility for any incidents and/or accidents of any nature whatsoever that may occur during the Contest and the enjoyment of the prizes. The Organizing Body’s liability is strictly limited to the delivery of the prize actually and validly won.

The Organizing Body may not be held liable in the event of use by the Winner and his/her companion of photographs of persons without their prior authorization.

ARTICLE 10 – PAYMENT

Participation in the Contest implies full acceptance of these Rules.

All practical difficulties of interpretation or application of the present Rules will be decided by the Organizing Body.

No telephone or written requests concerning the designation of winners will be answered.

ARTICLE 11: LIABILITY

11.1. The liability of the Organizing Body is strictly limited to the delivery of the prize actually and validly won.

11.2. Participants are expressly reminded that the Internet is not a secure network. In this respect, participation in the Game implies knowledge and acceptance, by all Participants, of the characteristics and limits of the Internet, in particular with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in all connections and transmissions on the Internet in general and on the Instagram community site in particular, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible viruses on the Internet network. Consequently, the Organizing Body may not be held responsible for contamination by viruses or intrusion by a third party into the terminal system of Participants in the Game, and declines all responsibility for the consequences of Participants’ connection to the network.

In particular, the Organizing Body may not be held liable for any damage caused to Participants, their computer equipment and the data stored on it, or for any consequences that may arise from this on their personal or professional activity. It is the responsibility of each Participant to take all appropriate measures to protect his/her own data and/or Instagram account, and participation in the Game is under his/her sole responsibility.

11.3. The Organizing Body may cancel all or part of the Game if it appears that fraud has occurred in any form whatsoever, in particular computer fraud in the context of participation in the Game or the determination of the Winner. In such a case, the Organizing Body reserves the right not to award the prize to any fraudsters and/or to prosecute the perpetrators of such frauds before the competent courts.

11.4. The Organizing Body will make its best efforts to allow access to the Game at all times. The Organizing Body may, at any time, in particular for technical reasons or reasons of updating or maintenance, interrupt the Game. The Organizing Body shall in no event be liable for such interruptions or their consequences.

ARTICLE 12 – PERSONAL DATA

For the purposes of organizing this contest, the organizing company is required to collect the names of participants’ Instagram accounts. The Winner will be selected by random draw from this list, which will be deleted in the month following the draw.

The provision of nominative information concerning the Winner is necessary for the proper execution of the prize in this Contest. This information will not be communicated to any third party.

In accordance with regulations on the protection of personal data, the Winner has the right to access, oppose, rectify and delete personal data concerning him/her, as well as the right to obtain the limitation of processing and to withdraw his/her consent by sending a letter (with a copy of an identity document) to :

You also have the right to lodge a complaint with a supervisory authority.

ARTICLE 13 – APPLICABLE LAW AND JURISDICTION

The Contest, the Rules and their interpretation are governed by French law.

Any dispute or legal action relating to the Regulations that cannot be settled amicably shall be submitted to the competent French courts.
