Chocolate Shooow competition

The Game and its promotion are not managed or sponsored by Instagram. In this context, the Organizing Body discharges Instagram of any responsibility concerning all elements related to the Game, its organization and promotion.

Article 2 – DATE OF OPERATION

The Contest runs from Thursday, December 5, 2024 at 12:00 p.m. to Wednesday, December 18, 2024 at 11:59 p.m. (Paris date and time).

Article 3 – CONDITIONS OF PARTICIPATION

3.1. La participation au Jeu implique, l’acceptation sans réserve du présent règlement dans son intégralité, des règles de déontologie en vigueur sur Internet, ainsi que des lois, règlements et autres textes en vigueur en France. Le non-respect des conditions de participation énoncées dans le Règlement entraînera la nullité de la participation en cause.

3.2. La participation au Jeu est réservée à toute personne physique réunissant à la date du début du Jeu les conditions cumulatives suivantes (ci-après le « Participant ») :

– Be of legal age ;

– Have an Internet connection and a personal account on the Instagram community site (“Instagram Account”)

– Reside in mainland France ;

– Have a personal electronic address (email) to which they can, if necessary, be contacted for the purposes of managing the game;

– Official identification;

– Be able to go (by their own means) to Comptoirs Les Deux Magots at 2 rue de Buci, 75006 Paris to claim the prize if they win the Game.

3.3. Sont exclues de toute participation au Jeu les personnes mineures, les membres du personnel de la société organisatrice (SAS LES DEUX MAGOTS) et les membres de leur famille proche (parents, frères et sœurs ou toute autre personne résidant dans le même foyer).

3.4. Seules seront retenues les participations conformes à l’ensemble des stipulations du Règlement. En conséquence, la Société Organisatrice se réserve le droit de faire toutes les vérifications nécessaires en ce qui concerne l’identité, l’âge et les coordonnées de chaque Participant.

Article 4 – CONDITIONS OF PARTICIPATION

Participation in the Game-Contest implies express and unreserved acceptance of the present Rules, in their entirety, and of the legislation in force on French territory (in particular, the laws relating to Information Technology, Civil Liberties, public decency and literary and artistic property).

Participation in the Contest is free and no purchase is necessary for the duration of the Contest.

4.1. Le Jeu sera accessible exclusivement depuis le compte Instagram des Deux Magots ( https://www.instagram.com/comptoirslesdeuxmagots ). Toute participation au Jeu sur papier libre ou sous toute autre forme est exclue.

The Participant can access the game after logging on to Instagram and visiting the aforementioned page. By participating, the Participant acknowledges that he/she has read these rules and accepts them unreservedly.

The publication dedicated to the competition will be posted and pinned on the Comptoirs Les Deux Magots Instagram page for the duration of the competition.

To participate in the game, you must :

– comment on the question asked in the publication

– follow the Comptoirs les Deux Magots account

Only Participants meeting these criteria will be accepted by the Organizing Body and will be able to take part. Any entry to the Contest that is incomplete, does not comply with the conditions set out in these Rules, is falsified, is validated after the entry deadline or contains false information will be considered null and void.

4.2. Sera notamment refusé de plein droit, mais sans que cette liste ne soit limitative, tout commentaire :

– vulgar, pornographic, racist, paedophilic or harmful to minors; – defamatory, insulting or slanderous towards third parties, natural or legal persons;

– of a political nature and/or deemed sensitive by the Organizing Body;

– infringe the privacy or image rights of third parties and/or contravene applicable laws;

– contrary to morality and/or public order;

– reproducing an item subject to intellectual or industrial property rights, such as, but not limited to, an original work, a trademark, a registered design, a patent, etc.

Similarly, the Participant undertakes to comply with the rules in force concerning intellectual property, and thus not to reproduce, represent, distribute or modify in any way whatsoever any content (signs, writings, images or messages of any kind) for which he/she has not obtained the express authorization of the rights holders at the time of his/her participation.

Each Participant may participate only once during the entire duration of the Contest and may participate only on his or her own behalf.

Article 5 – AWARDS

The organizing company is offering ten (10) prizes to be awarded to participants selected at random:

• hot chocolate with whipped cream
• a box of 5 “financiers des Deux Magots” (to be chosen from the sweet flavours on the à la carte menu at the time of the participant’s visit)

It is specified that the lot offered includes only what is indicated above with the exception of anything else. Any additional costs (transport, additional drinks….) will be borne by the Winners.

Article 6 – DESIGNATION OF WINNERS – RANDOM DRAWING

The Winners will be chosen from among all the participants in a draw to be held on Thursday, December 19, 2024 at noon at the organizing establishment.

The Organizing Body will contact the Winner no later than noon on December 19, 2024, in accordance with the terms and conditions specified in the following article.

Article 7 – ALLOCATION OF LOTS

The Organizing Body will contact the winners no later than December 19, 2024 by private message on Instagram. They will then be asked to provide the following information to verify their identity (last name, first name, address, city, postal code, telephone number, e-mail address).

Winners must indicate their wish to receive the prize by return message no later than January 07, 2025 at 11:59 pm. Failure to reply by this deadline will result in the Winner relinquishing the prize.

No notification will be sent to Participants who have not won.

The prize awarded may not be contested in any way whatsoever by the Winners. The prize is strictly personal, and may not be transferred or sold to any third party whatsoever; it may not be the subject, on the part of the Organizing Body, of any reimbursement in cash or any exchange or remittance of its total or partial counter-value, in kind or in cash.

The Prize will be awarded to the Winners drawn at random. However, it is possible for the Winners to designate a third party to replace them and benefit from the Prize won by drawing lots, provided that they present the name of the person drawn when collecting the Prize.

The prize can be collected within 2 months of the draw, until Sunday February 23, 2025 at 7:59pm.

ARTICLE 8 – FORCE MAJEURE

The Organizing Body may not be held liable if, for a reason beyond its control and/or in the event of force majeure, the Contest should be shortened, modified, postponed or cancelled; and this without any compensation being due to participants.

ARTICLE 9 – LIMITATION OF LIABILITY

The Organizer may not under any circumstances be held responsible for, without this list being limitative:

– the loss of any data;

– preventing or limiting the possibility of participating in the Game;

More generally, the Organizer declines all responsibility for any incidents and/or accidents of any nature whatsoever that may occur during the Contest and the enjoyment of the prizes. The Organizing Body’s liability is strictly limited to the delivery of the prize actually and validly won.

ARTICLE 10 – PAYMENT

Participation in the Contest implies full acceptance of these Rules.

All practical difficulties of interpretation or application of the present Rules will be decided by the Organizing Body.

No telephone or written requests concerning the designation of winners will be answered.

ARTICLE 11: LIABILITY

11.1. La responsabilité de la Société Organisatrice est strictement limitée à la délivrance du lot effectivement et valablement gagné.

11.2. Il est expressément rappelé que l’Internet n’est pas un réseau sécurisé. A cet égard, la participation au Jeu implique la connaissance et l’acceptation, par tout Participant, des caractéristiques et des limites de l’Internet, notamment en ce qui concerne les performances techniques, les temps de réponse pour consulter, interroger ou transférer des informations, les risques d’interruption, et plus généralement, les risques inhérents à toutes connexion et transmission sur Internet en général et sur le site communautaire Instagram en particulier, l’absence de protection de certaines données contre des détournements éventuels et les risques de contamination par des éventuels virus sur le réseau Internet. En conséquence, la Société Organisatrice ne saurait être tenue pour responsable notamment de la contamination par d’éventuels virus ou de l’intrusion d’un tiers dans le système du terminal des Participants au Jeu et décline toute responsabilité quant aux conséquences de la connexion des Participants au réseau.

In particular, the Organizing Body may not be held liable for any damage caused to Participants, their computer equipment and the data stored on it, or for any consequences that may arise from this on their personal or professional activity. It is the responsibility of each Participant to take all appropriate measures to protect his/her own data and/or Instagram account, and participation in the Game is under his/her sole responsibility.

11.3. La Société Organisatrice pourra annuler tout ou partie du Jeu s’il apparaît que des fraudes sont intervenues sous quelque forme que ce soit, notamment de manière informatique dans le cadre de la participation au Jeu ou de la détermination du Gagnant. Elle se réserve, dans cette hypothèse, le droit de ne pas attribuer le lot à des fraudeurs et/ou de poursuivre devant les juridictions compétentes les auteurs de ces fraudes.

11.4. La Société Organisatrice fera ses meilleurs efforts pour permettre à tout moment un accès au Jeu. La Société Organisatrice pourra, à tout moment, notamment pour des raisons techniques ou des raisons de mise à jour ou de maintenance, interrompre le Jeu. La Société Organisatrice ne sera en aucun cas responsable de ces interruptions et de leurs conséquences.

ARTICLE 12 – PERSONAL DATA

For the purposes of organizing this contest, the organizing company is required to collect the names of participants’ Instagram accounts. The Winners will be selected by random draw from this list, which will be deleted in the month following the draw.

The provision of nominative information concerning the Winners is necessary for the proper execution of the present Contest prize. This information will not be communicated to any third party.

In accordance with regulations on the protection of personal data, Winners have the right to access, oppose, rectify and delete personal data concerning them, as well as the right to obtain the limitation of processing and to withdraw their consent by sending a letter (with a copy of an identity document) to :

You also have the right to lodge a complaint with a supervisory authority.

ARTICLE 13 – APPLICABLE LAW AND JURISDICTION

The Contest, the Rules and their interpretation are governed by French law.

Any dispute or legal action relating to the Regulations that cannot be settled amicably shall be submitted to the competent French courts.
